Is justice delayed justice denied? An empirical approach

Improving judicial performance in order to enhance the business environment has been a policy goal for many governments last decades. Following suggestions of several international organizations, most countries have tried speed up their case resolution systems by streamlining procedure. However, not as much attention devoted test potential drawbacks similar reforms terms supplying quicker but yet qualitatively inferior justice, thus contradicting well-known legal maxim justice delayed is denied. The present work wishes contribute empirical literature on topic proposing two alternative ways further disentangle relationship between and quality. Exploiting dataset 171 2003–2016 time period, we find statistically significant evidence strong negative courts’ delay countries’ quality justice. While intrinsic limits this kind institutional analysis suggest caution when interpreting our estimates proof causality, more robust suggesting that characterized faster judiciaries seem be equally affected deterioration confirming aforementioned maxim, at least descriptively.
